BB Cycles Terms of Service

Welcome to BB Cycles.

These Terms of Service govern your use of the BB Cycles website and your purchase of products from BB Cycles, including bicycles, BMX bikes, frames, parts, accessories, clothing, protective equipment and other products available through our website.

By using our website, creating a BB Cycles account, or placing an order through our website, you agree to these Terms of Service.

If you do not agree with these Terms, please do not use our website or place an order.

These Terms should be read together with our Privacy Policy, Shipping Policy and Returns Policy, where applicable.


1. About BB Cycles

BB Cycles is an Australian BMX retailer based in Western Australia.

In these Terms:

  • "BB Cycles", "we", "us" or "our" means BB Cycles.

  • "Website" means www.bbcycles.com.au and any related BB Cycles online services.

  • "Customer", "you" or "your" means the person using the Website or purchasing products from BB Cycles.

  • "Product" means any product offered for sale by BB Cycles.


2. Using the BB Cycles Website

You agree to use the Website lawfully and in a manner that does not interfere with the Website, our business, other customers or our systems.

You must not:

  • use the Website for unlawful, fraudulent or abusive purposes;

  • attempt to gain unauthorised access to our Website, systems or customer accounts;

  • interfere with the operation or security of the Website;

  • knowingly provide false or misleading information;

  • use automated systems or methods to interfere with or excessively access the Website; or

  • reproduce, copy or commercially exploit BB Cycles content without permission.

We may restrict or terminate access to the Website where we reasonably believe it is necessary to protect BB Cycles, our customers or our systems.


3. Customer Accounts

A BB Cycles customer account is required to place an online order.

You are responsible for ensuring that the information associated with your account is accurate, complete and current.

You are responsible for keeping your account login details and password secure and for any activity conducted through your account.

You must notify BB Cycles if you believe your account has been accessed without your permission.

BB Cycles may suspend or terminate an account where we reasonably believe it has been used for fraudulent, abusive, unlawful or inappropriate activity.

We may also restrict future orders or account access where reasonably necessary due to suspected fraud, repeated abuse of our policies, threatening or abusive conduct, or other conduct that presents a reasonable risk to BB Cycles or our customers.

Any such action will remain subject to applicable Australian law.


4. Customers Under 18

Customers under 18 may use the BB Cycles Website and purchase products where they have the necessary legal capacity or the consent and involvement of a parent or legal guardian.

Where required, a parent or legal guardian may be responsible for the transaction and any obligations associated with the order.

By placing an order, you confirm that you have the legal capacity to enter into the transaction or have obtained any necessary consent.


5. Products and Product Information

BB Cycles takes reasonable care to ensure that product descriptions, specifications, images, pricing and other information displayed on our Website are accurate.

However:

  • manufacturers may change product specifications without notice;

  • colours may appear differently depending on your screen, device or display settings;

  • product images may sometimes represent a product range or model and may not show every minor variation;

  • product availability can change quickly; and

  • minor differences may occur between product images and the actual product supplied.

Where there is a discrepancy between information displayed by a third-party website and information displayed on the BB Cycles Website, the information displayed on the relevant BB Cycles product page at the time of purchase will generally be the applicable product information, subject always to your rights under Australian Consumer Law.

BB Cycles does not guarantee that every product specification will remain unchanged after purchase where the manufacturer subsequently changes the product.


6. Stock Availability

BB Cycles generally lists products on our Website that we physically have available in-store.

However, because products may be sold in-store, online or through other sales channels, there may occasionally be a short delay between an item being sold and our Website inventory being updated.

If an item ordered online is no longer available, BB Cycles may:

  • contact you and offer an alternative product;

  • offer an alternative size, colour or specification where appropriate; or

  • cancel the affected portion of the order and provide a refund.

We will work with you to find the best available solution wherever possible.

If we cannot fulfil the order, you will receive a refund for the affected product.


7. Placing an Order

When you place an order through the BB Cycles Website, you are making a purchase from BB Cycles under these Terms.

Orders with a total value of less than $5,000 AUD are generally accepted when the order is successfully placed and payment is authorised, subject to these Terms.

Orders of $5,000 AUD or more may be subject to additional confirmation by BB Cycles before the order is accepted and processed.

For higher-value orders, we may contact you to confirm:

  • the order;

  • customer details;

  • delivery information;

  • payment information; and/or

  • product availability.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • the product is unavailable;

  • there is an obvious pricing or product information error;

  • payment cannot be successfully processed;

  • we reasonably suspect fraud or unauthorised activity;

  • we cannot reasonably fulfil the order; or

  • the order does not comply with these Terms.

Where BB Cycles cancels an order before supply, any payment received for the cancelled order will be refunded.

Nothing in these Terms limits any rights you have under Australian Consumer Law.


8. Pricing Errors

BB Cycles takes care to ensure that pricing on our Website is accurate.

However, occasional errors may occur.

If a product has been listed at an obviously incorrect price due to a genuine website, data-entry, technical or other error, BB Cycles reserves the right to correct the error and cancel the affected order.

Where an order is cancelled due to an obvious pricing error, any payment received for the affected order will be refunded.

This does not affect your rights under Australian Consumer Law.

Third-Party Shopping and Advertising Platforms

Product information displayed by third-party platforms, search engines, shopping services, comparison websites or advertising platforms may occasionally be incorrect, outdated or different from the information displayed on the BB Cycles Website.

This may include incorrect prices, availability or product information.

The price applicable to an online purchase is the price displayed on the BB Cycles Website at checkout at the time the order is placed, subject to the provisions relating to obvious pricing errors above.

BB Cycles is not responsible for pricing or product information incorrectly displayed by third-party platforms.


9. Special Orders

A Special Order is a product that BB Cycles does not normally keep in stock and must obtain specifically for a customer.

Special Orders may include:

  • products not normally stocked by BB Cycles;

  • products specifically ordered from a supplier for a customer;

  • non-stock colours or sizes;

  • bicycles ordered specifically for a customer;

  • frames;

  • parts; and

  • other products requested specifically by a customer.

A deposit of generally 20%–30% of the order value may be required before BB Cycles places a Special Order.

The deposit percentage will be determined by BB Cycles based on the product, value and circumstances of the order.

Once a Special Order has been approved and ordered from a supplier, the customer may not automatically cancel the order simply because they have changed their mind.

Where a Special Order can reasonably be resold by BB Cycles, we may, at our discretion, agree to cancel the order and refund some or all of the deposit.

Where the product has been specially ordered and cannot reasonably be resold, BB Cycles may retain the deposit.

If the supplier is unable to fulfil the Special Order, BB Cycles will refund the deposit paid for that order.

These provisions do not limit any rights you may have under Australian Consumer Law.


10. Custom-Built Bikes

Custom-built bikes require customer approval of the proposed specification before parts are ordered.

The customer may be provided with a proposed specification including items such as:

  • frame;

  • fork;

  • wheels;

  • cranks;

  • handlebars;

  • stem;

  • tyres;

  • seat and seatpost; and

  • other components.

BB Cycles will obtain customer approval before ordering components for a custom build.

Once a specification has been approved and components have been ordered specifically for the build, changes or cancellations may result in additional costs.

If a customer requests a change after parts have been ordered, BB Cycles will assess the request on a case-by-case basis.

Where a component can reasonably be returned, exchanged or resold, BB Cycles may assist with the change.

Where a component cannot reasonably be returned or resold, the customer may be responsible for the associated cost.

A deposit of generally 20%–30% may be required before components are ordered.

Where a customer cancels a custom build after components have been ordered because they have changed their mind, the deposit may be retained.

Where the cancellation results in additional costs that cannot reasonably be recovered or avoided, BB Cycles may discuss those costs with the customer before proceeding.


11. Custom Wheelsets

Custom wheelsets are built specifically to the customer's selected specifications.

Customers are required to approve the wheelset specifications before BB Cycles commences the build.

Specifications may include:

  • hubs;

  • rims;

  • spokes;

  • nipples;

  • colours; and

  • other selected components.

Once a custom wheelset has been built to the approved specifications, it is not eligible for return due to change of mind.

This does not affect any rights you may have under Australian Consumer Law where the wheelset is faulty, defective or otherwise fails to meet a consumer guarantee.


12. Component Availability and Substitutions

Where a component selected for a custom build or Special Order becomes unavailable, discontinued or unavailable from the supplier, BB Cycles may contact the customer to discuss an alternative.

Where appropriate, BB Cycles may recommend an equivalent or comparable replacement component.

A substitution will not be made without customer approval where the substitution materially changes the agreed specification.


13. Complete Bikes

Pickup

Complete bikes purchased for pickup from BB Cycles will generally be assembled and undergo a basic safety check before collection.

Customers remain responsible for carrying out final checks and adjustments before riding.

Shipping

Complete bikes shipped by BB Cycles are partially disassembled for safe transportation.

Customers are responsible for ensuring that the bicycle is correctly assembled, adjusted and checked before riding.

BB Cycles recommends that customers have shipped bicycles assembled and checked by a qualified bicycle mechanic where they are not confident performing the required assembly and adjustments themselves.

BB Cycles may provide additional assembly information or instructions where available.


14. Pricing, Promotions and Discounts

All prices displayed on the BB Cycles Website are in Australian Dollars (AUD) and include GST where applicable.

BB Cycles may offer:

  • sale pricing;

  • clearance pricing;

  • promotional codes;

  • special offers; and

  • price matching where applicable.

Promotional offers may be subject to additional conditions displayed with the relevant promotion.

BB Cycles reserves the right to correct genuine errors in promotional pricing or promotional terms.

Where a promotion has been applied incorrectly due to an obvious technical or pricing error, BB Cycles may contact the customer to correct the issue or cancel the affected order and provide a refund.


15. Payment

BB Cycles currently accepts online payments through:

  • Stripe;

  • PayPal; and

  • Afterpay.

Other payment methods may be available for in-store or other transactions but are not necessarily available for online orders.

Online orders cannot be paid by bank transfer unless BB Cycles specifically agrees otherwise.

BB Cycles may decline or cancel an order where:

  • payment is unsuccessful;

  • payment is reversed or disputed;

  • payment information appears invalid;

  • we reasonably suspect fraud or unauthorised activity; or

  • the payment provider does not approve the transaction.

BB Cycles may contact you to verify an order or payment where reasonably necessary.


16. Shipping and Delivery

BB Cycles ships orders within Australia and to New Zealand where shipping is available for the relevant product.

Shipping availability may vary depending on the product, size, weight, destination and carrier requirements.

Dispatch Times

BB Cycles aims to dispatch orders placed before 12:00pm Tuesday to Friday on the same business day.

Orders placed after 12:00pm will generally be dispatched the same business day where possible. If same-day dispatch is not possible, the order will generally be dispatched on the next business day.

Orders placed on Saturday, Sunday or Monday will generally be dispatched on the next business day.

Dispatch time is the time at which BB Cycles hands the parcel to the relevant delivery carrier.

Dispatch time is not the same as delivery time.

Delivery timeframes are estimates provided by the relevant carrier and may vary due to factors outside BB Cycles' reasonable control.

Carrier Delays

Once an order has been handed to the carrier, BB Cycles cannot control the carrier's delivery network, including delays, missed delivery attempts, weather events, transport disruptions or other carrier-related issues.

BB Cycles will assist customers in following up delivery issues where reasonably possible.

Nothing in this section limits any rights you may have under Australian Consumer Law.

Delivery Address

Customers are responsible for providing an accurate and complete delivery address when placing an order.

BB Cycles will make reasonable efforts to identify obvious address issues before dispatch.

If an order has been dispatched to an incorrect address supplied by the customer, the customer may be responsible for additional delivery, return or re-delivery costs.

Where an order is returned to BB Cycles because of an incorrect address, refused delivery or failure to accept delivery, additional shipping costs may apply before the order is re-sent.


17. Free Shipping

BB Cycles currently offers free regular postage on eligible orders over $200 AUD.

Free shipping does not automatically apply to:

  • complete bicycles;

  • frames;

  • oversized products;

  • bulky products;

  • products requiring special freight arrangements; or

  • other products identified as excluded from the free-shipping offer.

BB Cycles may charge additional freight where an order requires a specialised, oversized or otherwise non-standard shipping service.

Any applicable additional shipping charges will be communicated to the customer where reasonably possible before the order is dispatched.


18. Click & Collect

Customers may select Click & Collect where the option is available.

Orders selected for Click & Collect will generally be held for 30 days from the date the order is ready for collection.

Customers should contact BB Cycles if they require additional time.

Where an order has not been collected after 30 days and the customer has not contacted BB Cycles, we may contact the customer to provide a final opportunity to collect the order.

If the customer does not respond, BB Cycles may cancel the order and return the product to available stock.

Any refund will be processed in accordance with these Terms and applicable law.

Special Orders and custom products may be subject to additional conditions.


19. Returns and Change of Mind

BB Cycles offers a change-of-mind return policy in addition to your rights under Australian Consumer Law.

To be eligible for a change-of-mind return, the product must generally:

  • be returned within 14 days;

  • be unused;

  • be uninstalled;

  • be in brand-new, saleable condition;

  • include original packaging where reasonably possible; and

  • include all original accessories, manuals and components.

Products that have been used, installed, damaged, modified or otherwise made unsuitable for resale may not qualify for a change-of-mind return.

Change-of-Mind Return Period

Customers should contact BB Cycles within 14 days of receiving the product to request a return.

Products returned outside the standard 14-day period may be accepted at BB Cycles' discretion.

Where BB Cycles agrees to accept a return outside the standard return period, a 10% restocking fee may apply.

Return Shipping

The customer is responsible for return postage and shipping costs associated with a change-of-mind return.

BB Cycles is not responsible for loss or damage to products being returned by the customer until they are received by BB Cycles.


20. Products Excluded from Change-of-Mind Returns

The following products are generally not eligible for change-of-mind returns:

  • Sale or clearance products;

  • Special Orders;

  • Custom-built bicycles;

  • Custom wheelsets;

  • custom or specially configured products; and

  • complete bicycles that have been unboxed.

These exclusions apply to change-of-mind returns only and do not affect rights available under Australian Consumer Law.


21. Faulty Products, Warranties and Australian Consumer Law

BB Cycles takes product faults and warranty claims seriously.

If you believe a product purchased from BB Cycles is faulty, defective or has developed a problem, please contact BB Cycles before returning the product where reasonably possible.

BB Cycles may need to inspect or assess the product before determining the appropriate remedy.

Where a product is determined to be faulty and the issue is covered by Australian Consumer Law or an applicable manufacturer warranty, BB Cycles will work with the customer to provide the appropriate remedy.

Depending on the circumstances, this may include:

  • repair;

  • replacement;

  • refund; or

  • another appropriate remedy.

Where a product is determined to be faulty or covered by a warranty, BB Cycles will generally cover reasonable return shipping costs associated with the warranty/fault assessment.

Manufacturer warranties are additional to, and do not replace, your rights under Australian Consumer Law.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded under Australian Consumer Law.


22. Damage During Transit

If an order arrives visibly damaged, customers should:

  1. Photograph the external packaging before opening it where possible.

  2. Photograph any visible damage to the product.

  3. Contact BB Cycles as soon as reasonably possible.

  4. Keep the original packaging and shipping materials until BB Cycles advises otherwise.

BB Cycles may require photographs or other information to assist with a carrier claim or product assessment.

Customers should contact BB Cycles as soon as reasonably possible after discovering shipping damage.

This does not limit any rights available under Australian Consumer Law.


23. BMX Products, Bicycle Use and Safety

Bicycle and BMX riding, racing, freestyle riding and other cycling activities involve inherent risks, including the possibility of falls, crashes, injury and property damage.

Customers are responsible for using products appropriately and in accordance with:

  • manufacturer instructions;

  • applicable safety requirements;

  • product specifications;

  • intended use; and

  • appropriate maintenance and adjustment requirements.

Customers should ensure bicycles and components are properly assembled, adjusted and maintained before use.

Protective equipment should be used where appropriate and in accordance with applicable racing, sporting or safety requirements.

Customers are responsible for ensuring that products are suitable for their intended use, rider and riding conditions.

Where BB Cycles provides product advice or recommendations, that advice is based on the information available to us and the information provided by the customer.

Nothing in this section excludes or limits any rights the customer has under Australian Consumer Law.


24. Intellectual Property and Website Content

Unless otherwise stated, content on the BB Cycles Website is owned by or licensed to BB Cycles.

This includes, but is not limited to:

  • BB Cycles logos and branding;

  • photographs created by BB Cycles;

  • graphics;

  • website design;

  • written content;

  • product descriptions created by BB Cycles;

  • social media content; and

  • other original BB Cycles material.

You must not reproduce, modify, distribute or commercially exploit BB Cycles-owned content without our permission.

Customers may use BB Cycles product images or information for legitimate personal purposes, including advertising a product they own for private resale, provided that such use does not imply endorsement by BB Cycles or suggest that the customer is affiliated with BB Cycles.


25. Customer Reviews and Submitted Content

Customers may submit product reviews, photographs, videos, testimonials or other content to BB Cycles.

You must ensure that content you submit:

  • is truthful and not misleading;

  • does not infringe another person's intellectual property or privacy rights;

  • is not defamatory;

  • is not abusive, threatening or unlawful; and

  • is relevant to the product or BB Cycles service where applicable.

BB Cycles may remove or decline to publish content that we reasonably consider inappropriate, fraudulent, abusive, defamatory, irrelevant or otherwise unsuitable.

BB Cycles may contact customers to request permission to use their submitted photographs, videos, reviews or testimonials on our Website, social media or other marketing channels.

Customer content will only be used for these purposes where appropriate permission has been obtained.


26. Third-Party Services

BB Cycles uses third-party services to assist with operating our Website and business.

These may include payment providers, shipping carriers, analytics services, advertising platforms and other technology providers.

These services may include, among others:

  • Stripe;

  • PayPal;

  • Afterpay;

  • Australia Post;

  • TNT;

  • Google services;

  • Google Analytics; and

  • Meta/Facebook services.

Third-party services may have their own terms, conditions and privacy policies.

BB Cycles is not responsible for the independent operation, availability or policies of third-party services, except where required by applicable law.


27. Website Availability and Errors

We aim to keep the BB Cycles Website available, accurate and secure.

However, we do not guarantee that:

  • the Website will always be available;

  • the Website will be completely error-free;

  • all information will always be current;

  • every product will always be available; or

  • the Website will be free from technical problems or interruptions.

The Website may occasionally be unavailable due to maintenance, technical problems, hosting issues, updates or circumstances outside our reasonable control.

Where an error affects an order, BB Cycles will work with the customer to resolve the issue in accordance with these Terms and applicable law.


28. Third-Party Links

The BB Cycles Website may contain links to third-party websites or services.

These links may be provided for convenience or additional information.

BB Cycles does not necessarily endorse or control third-party websites and is not responsible for their content, availability, security or policies.

Customers should review the terms and privacy policies of third-party websites before using them.


29. Privacy

BB Cycles collects and uses personal information in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and manage personal information.

By using the BB Cycles Website or placing an order, you acknowledge that your personal information may be collected and used for purposes associated with operating our Website, processing orders, payment, delivery, customer service, warranty claims, marketing where permitted, fraud prevention and other legitimate business purposes.

Our Privacy Policy forms part of our overall Website terms and should be read together with these Terms of Service.


30. Limitation of Liability

To the maximum extent permitted by law, BB Cycles will not be responsible for loss, damage, delay or interruption caused by circumstances outside our reasonable control.

These circumstances may include:

  • carrier delays;

  • natural disasters;

  • severe weather;

  • transport disruptions;

  • supplier delays;

  • third-party service failures;

  • telecommunications or internet outages;

  • technical failures;

  • cyber incidents; or

  • other circumstances beyond our reasonable control.

Nothing in these Terms excludes, restricts or modifies any liability or consumer right that cannot legally be excluded, restricted or modified under Australian law, including the Australian Consumer Law.


31. Changes to These Terms

BB Cycles may update these Terms of Service from time to time.

BB Cycles uses third-party payment providers, including:

Customers may also choose to save payment information to their BB Cycles account where this functionality is available.

BB Cycles staff do not have access to the customer's complete saved card number. Our systems may display limited payment information, such as the last three digits and expiry date.

Payment information is processed through the relevant payment provider and may be subject to that provider's own privacy policy and terms.

For telephone orders, BB Cycles may collect card payment details verbally for the purpose of processing the transaction.

BB Cycles does not use customers' payment information for unrelated purposes.

  • make a purchase in-store

BB Cycles sells products that may be purchased for children and young people.

Our online customer accounts and purchases are intended to be managed by a parent or legal guardian where the customer is under 18.

BB Cycles does not ordinarily require or intentionally collect information such as a rider's age, date of birth, gender, race category or club/team information as part of a normal customer transaction.
